Rules of procedure and conditions

Art.1: Conclusion of the contract and payment terms

The contract, which we will send you personally, is concluded between the tenant and the owner. It becomes effective as soon as a signed copy of the contract is returned to the owner. The amount will be specified in the contract. A deposit of 200€ will also be charged. If the apartment is left in good condition, this deposit will be refunded in full, which will be deducted from the cleaning and consumption costs. If applicable, any compensation for damage to the property or its contents will be deducted. If the signed contract is not returned within 7 (seven) calendar days following the signing, the owner can, without any notice or compensation, again dispose of the object of the lease, and offer it for rent again.


Art.2: Calculation of the rental amount

This total amount must be transferred within 7 calendar days to the account number: BE79 9531 4734 9433.

After the rental period, the difference between the deposit and the cleaning and consumption costs will soon be refunded if no damage was fixed by the owner or the cleaning crew.


Art.3: Costs

Utilities (5€ per night): electricity, water, heating, etc.
Cleaning (40€ once-only): A cleaning team ensures that everything is cleaned again for the following tenants. In this way you can be sure of an arrival in a clean and tidy accomodation.

Each bed is equipped with a mattress protector, a duvet and a pillow.

Bath and bed linen can be rented for a fixed cost of 10€ regardless of the number of persons or the length of your rental period.
Of course you can also do this yourself without any costs.

  • Sleeping cushions are all 60cm x70cm
  • Mattresses are 200cm x 180cm for large bed and 2 times 200cm x 90cm for bunk beds
  • Duvets are 200cm x220cm for large bed and 2 times 200cm x140cm for bunk beds

All these costs will be deducted from the refund of the deposit.


Art.4: Return of the rented property – complaints

The rented property is, in accordance with the contract, made available to the tenant in a clean and tidy manner. If any damage is found when the rented property is made available, the tenant is obliged to notify the owner immediately. If not, the rented property will be deemed to have been handed over in perfect condition. The tenant will leave the accommodation clean and tidy. If the stay is not left clean and tidy, additional cleaning costs may be deducted from the deposit on top of the already fixed cleaning costs of 40 €.

Additional cleaning costs may be charged when :

  • Frigo is not empty and / or cleaned (5€ extra)
  • Cooking rings are not cleaned up (5€ extra)
  • Toaster is not cleaned up (5€ extra)
  • Coffee machine not cleaned up (5€ extra)
  • Oven not cleaned up (5€ extra)
  • Microwave is not cleaned up (5€ extra)
  • Dishwasher is not emptied and/or cleaned (5€ extra)
  • Garbage bags, glass and/or paper are not included (5€ extra)

These extra costs are paid in full to the cleaning team as only they have extra work to do during their already limited cleaning time. Please take this into account so that they do not have to do any unnecessary work and that you do not have any unnecessary costs after your stay.


Art.5: Precautions for use

The tenant must take care of the rented property. The tenant must comply with the internal regulations of the “Marbella” residence and the noise regulations. These regulations will also be sent to you by e-mail together with the rental contract.

The rented property may only be occupied by the maximum number of people – four – as stated in the rental contract. Subletting is not allowed. The tenant must ensure that the co-tenants comply with these contractual provisions. If the tenant or a co-tenant clearly does not comply with the provisions concerning care of the rented property, he will be held responsible for this. In extreme cases, the owner may terminate the contract, with immediate effect and without compensation.


Art.6: Entry and return of the rented property

At the end of the rental contract, the rented property must be returned in good order and in accordance with the inventory drawn up on arrival. The tenant is obliged to pay for any damage or missing items in the inventory.

The arrival and departure times are as follows:

Arrival : 14u00

Departure : 11u00


Art. 7: Cancellation

The hirer may terminate the contract at any time, subject to the payment of a lump-sum indemnity determined as follows :

  • Up to 7 days before arrival: 30% of the rental price
  • Between 7 days and 3 days before arrival: 50% of the rental price
  • Between 3 days and 1 day before arrival: 80% of the rental price
  • On the day of arrival: 100% of the rental price

The tenant has the right to propose another tenant as a replacement. This must be accepted by the owner and considered solvent. He takes over the contract with the same conditions. The tenant and his deputy are jointly and severally liable for the payment of the rent.
Art.8: Force majeure

If the hiring or its continuation is prevented by force majeure (environmental or natural disasters, government measures, etc.), unforeseen or unavoidable circumstances, the owner will refund to the hirer the amount paid or the corresponding part, without any right to compensation.

Art.9: Liability

The tenant is jointly and severally liable for all damage and/or loss caused by him or the co-tenants, regardless of whether this was caused by acts or omissions of them or of third parties, which were on the domain through their actions. The owner cannot be held responsible for :

  • Theft, loss or damage to property of the tenant, during or as a result of his stay
  • Defects in or out of operation of technical utilities or the failure or exclusion of utilities on the property, by third parties

Art.10: Generalities

Smoking in the apartment and general parts of the building is NOT allowed.

Pets are NOT allowed in the rental property.


Art.11: Applicable law and competent court

Belgian law is applicable. The only competent court is that of the location of the rented property.

This rental agreement will only come into effect once it has been returned, signed by the tenant, with the words ‘read and approved’. This can be done by mail to info@blankenberge-marbella.be or by letter to the following adress :
